That means that a lawsuit MUST be filed within two years of the date of the incident. Indiana Code 34-1-2-2
To further complicate matters, if your case is one that involves a state governmental agency, such as a police department, a highway department, or some other similar agency of state government, a NOTICE OF TORT CLAIM must be filed within 180 days of the date of the incident. Indiana Code 34-4-16.5-7.
We are willing to take most personal injury cases on a contingent fee basis. If the case is settled before a lawsuit if filed, our fee is 25% of recovery, plus any expenses that we advance. If the case is resolved after a lawsuit is filed but before the final pre-trial conference, our fee is one-third of recovery, plus expenses that we advance. If the case is settled after the final pre-trial conference or we are successful at trial, our fee is 40% of recovery, plus expenses. In the event of an appeal, our fee will be discussed with you.
